40 Facts That Prove That America’s Moral Collapse Is Spinning Wildly Out Of Control

According to a brand new survey that was just conducted by the Pew Research Center, 77 percent of all Americans are either “very worried” or “fairly worried” about America’s moral health. Of course the truth is that we should all be deeply concerned, because we can see evidence of the cancerous moral decay that is eating away at the foundations of our society all around us. In life, each one of us gets to make choices, and some of those choices can lead to very bad outcomes. We all have old friends that “got on the wrong path”, and their lives ended up becoming cautionary tales. Well, the same principle applies to nations as a whole. America has been given very clear choices between good and evil, life and death, blessings and curses over and over again, and we have consistently made the wrong choices. If we stay on this road, there is only one result that will be possible.

As long as we are drawing breath, there is always an opportunity to turn things around. That is true for individuals, and it is also true for our entire nation. But if we continue running toward evil, it is only a matter of time before exceedingly painful consequences overtake us.

The following are 40 facts that prove that America’s moral collapse is spinning wildly out of control…

#1 America has killed more than 60 million children since Roe v. Wade was decided in 1973. The federal government endorses this activity by heavily funding the country’s leading abortion provider, and after that abortion provider harvests the organs of the dead children, the federal government also heavily funds the research that is conducted on those harvested organs.

#2 According to a Quinnipiac University poll from last year, 63 percent of all Americans want to keep Roe v. Wade in place.

#3 America is a global leader in sexual depravity. If you doubt this, just check out what is going on in Cleveland at the end of this month.

#4 Americans are now more likely to die from an opioid overdose than they are from a car accident.

#5 In the city of Baltimore, approximately one out of every four babies is born as an opioid addict.

#6 Overdosing on drugs has now become the leading cause of death for Americans under the age of 50.

#7 McDonalds feeds approximately 70 million people a day globally. Pornhub gets more than 78 million visits a day.

#8 The teen birth rate in the United States is higher “than in any other industrialized country in the world”.

#9 According to the CDC, approximately 110 million Americans have a sexually-transmitted disease right now.

#10 The CDC also tells us that there are approximately 20 million new sexually transmitted disease cases in the U.S. every single year.

#11 The number of married couples with children in the U.S. just reached a 56 year low.

#12 According to the United Nations Population Fund, 40 percent of all births in the U.S. now happen outside of marriage. But if you go back to 1970, that figure was sitting at just 10 percent.

#13 At this point, approximately one out of every three children in the United States lives in a home without a father.

#14 Approximately one-fourth of the entire global prison population is in the United States.

#15 By the time an American child reaches the age of 18, that child will have seen approximately 40,000 murders on television.

Cassandra Fairbanks’ account of her visit to Julian in the Ecuadorean Embassy paints a truly harrowing picture of the conditions in which he is being held. Last week after receiving a message from Julian I applied to the Ecuadorean Embassy to go and see him. I have done this many times but a new regime has established involving forms and strict time windows.

The Ecuadorean Embassy claim not to have received my email with the application, which is peculiar as I received no undeliverable message and bcc copyees received it. I therefore re-sent it with a new email advising they may change the date and time if the original is not now achievable. I have heard nothing so far in response.

Chelsea Manning is currently entering her fourth week of solitary confinement for refusing to testify against Assange before a grand jury. The United States wishes to extradite Julian Assange to face charges, not of collusion with the non-existent “Russiagate”, not with a sexual offence stitch-up. They wish to charge him with publishing the evidence of extensive US war crimes in Iraq and Afghanistan, and with publishing the US diplomatic cables including the one I drew on last week which prove that the US and UK conspired to establish a marine reserve around the Chagos Islands as an environmental fraud to maintain the deportation of the islanders from what is now the US nuclear and torture base.

Many tens of billions of dollars are spent every year on western security services, and they are not stupid. The use of contrived sexual allegations to detach progressive figures from their support base is well established practice. But the allegations against Assange in Sweden are long gone, never reached the stage of a charge, and fell away immediately once Assange was finally interviewed by Swedish police and prosecutors in the Embassy. The whole Russiagate fabrication has been exploded as the media confection it always was.

The false left and liberals have until now been delighted to hide behind Russiagate or Sweden to avoid asking themselves the fundamental question. Julian Assange is merely a journalist and publisher. The fundamental question is, should a journalist or publisher be locked up for life for publishing leaked documents showing war crimes? If the answer is yes, where is press freedom?

That is now the unavoidable question. The security service patsies at the Guardian, however, prefer to retail ludicrous accusations from CIA asset Lenin Moreno – accusations motivated by the revelation of Moreno’s Panamanian offshore accounts – in frenzied efforts to maintain the tactic of diversion.

The Tables Turn in Russian Collusion Hunt

The irony of the entire Russian collusion hoax is that accusers who cried the loudest about leaking, collusion, lying, and obstruction are themselves soon very likely to be accused of just those crimes.

Now that Robert Mueller’s 674-day, $30 million investigation is over and has failed to find the original goal of its mandate—evidence of a criminal conspiracy between the Trump presidential campaign and the Russian government to sway the 2016 election—and now that thousands of once-sealed government documents will likely be released in unredacted form, those who eagerly assumed the role of the hunters may become the hunted, due to their own zealous violation of the nation’s trust and its laws.

Take Lying
Former FBI Director James Comey’s testimonies cannot be reconciled with those of his own deputy director Andrew McCabe. He falsely testified that the Steele dossier was not the main basis for obtaining FISA court warrants. On at least 245 occasions, Comey swore under oath that he either did not know, or could not remember, when asked direct questions about his conduct at the FBI. He likely lied when he testified that he did not conclude his assessment of the Clinton illegal email use before he had even interviewed Clinton, an assertion contradicted by his own written report. I guess his credo and modus operandi are reflected in the subtitle of his recent autobiography A Higher Loyalty: “Truth, Lies, and Leadership.”

Andrew McCabe currently is under criminal referral for lying to federal investigators about leaking to the media. He and Deputy Attorney General Rod Rosenstein each have accused each other of not telling the whole truth about their shared caper of trying to force President Trump out of office by invoking the 25th Amendment.

Former Director of National Intelligence James Clapper has admitted to lying under oath to Congress—and since lied about his earlier admission of that lying. His recent sworn congressional testimony of not having leaked information about the Steele dossier to the media is again likely to be untrue, given that Clapper had admitted to speaking to CNN’s Jake Tapper about the dossier’s contents. CNN, remember, would in turn go on to hire the mendacious Clapper as an analyst. And once on air, Clapper would insist that Trump was both a Russian asset and thus guilty of collusion crimes greater than those of Watergate. Lies. All lies.

Former CIA Director John Brennan has admitted to lying under oath to Congress on two occasions. He may well face further legal exposure. When he lost his security clearance, he repeatedly lied that Trump was guilty of collusion, however that non-crime is defined. And as the Mueller probe wound down, Brennan with pseudo-authority and trumped-up hints of phony access to secret intelligence sources deceitfully assured the nation that Trump within days would face indictment—perhaps along with his family members.

Brennan in 2016 also reached out to foreign intelligence services, primary British and Australian, to surveille and entrap Trump aides, as a way of circumventing rules preventing CIA monitoring of American citizens. And he may well have also reverse-targeted Americans, under the guise of monitoring foreign nationals, in order to build a case of so-called Trump collusion.

Finally, Brennan testified to Congress in May 2017 that he had not been earlier aware of the dossier or its contents before the election, although in August 2016 it is almost certain that he had briefed Senator Harry Reid (D-Nev.) on it in a spirited effort to have Reid pressure the FBI to keep or expand its counterintelligence investigation of Trump during the critical final weeks of the election.

Clinton aides Cheryl Mills and Huma Abedin likely also lied to FBI investigators when they claimed they had no knowledge while working at the State Department that their boss, Secretary of State Hillary Clinton, was using an illegal private email server. In fact, they had read her communications on it and actually inquired about its efficacy.

Samantha Power, the former U.N. ambassador, in her last year in office requested on more than 260 occasions to unmask names of Americans monitored by the government. Yet Power later claimed that most of these requests were not made by her. And yet she either does not know or does not cite who exactly used her name to make such requests during the election cycle. In any case, no one has come forward to admit to the improper use of Power’s name to request the hundreds of unmaskings.

Susan Rice, the former Obama national security advisor, could have made a number of unmasking requests in Power’s name, although she initially denied making any requests in her own name—a lie she immediately amended. Rice, remember, repeatedly lied on national television about the cause and origins of the Benghazi attack, denied there were cash payments for hostages in the Iran deal, misled about the conduct of Beau Bergdahl, and prevaricated over the existence and destruction of weapons of mass destruction in Syria.

Deputy Attorney General Bruce Ohr did not tell the truth on a federal written disclosure required by law when he omitted the key fact that his wife Nellie worked on Christopher Steele’s Fusion GPS dossier. Ohr’s testimony that he completely briefed key FBI officials on the dossier in July or August 2016 is not compatible to what former FBI attorney Lisa Page has testified to concerning the dates of her own knowledge of the Steele material.

Take Foreign Collusion
Christopher Steele is a foreign national. So are many of the Russian sources that he claims he had contacted to solicit dirt on Donald Trump and his campaign aides. In fact, John Brennan’s CIA, soon in consultation with the FBI, was used in circuitous fashion to facilitate surveillance of Donald Trump’s campaign through the use of foreign nationals during the 2016 campaign.

Foreigners such as Maltese professor Josef Mifsud, and former Australian minister for foreign affairs Alexander Downer and an array of intelligence contractors from the British Foreign and Commonwealth Office (FCO) mysteriously met with minor Trump aide George Papadopoulos and others. It is likely that to disguise American intelligence agencies’ efforts to besmirch, surveille, and leak to the press damaging unfounded rumors about the Trump campaign that John Brennan enlisted an entire cadre of foreign nationals. And it is likely to be the most egregious example of using non-U.S. citizens to affect the outcome of an election in our history. If there is a crime of foreign collusion—a conspiracy of U.S. officials to use foreigners to interfere with an American election—then Brennan’s efforts are the textbook example.

Take Leaking
Many of the names unmasked by requests from Samantha Power and Susan Rice were leaked illegally to the media. James Comey himself leaked confidential memos of presidential conversations to the press; in at least one case, the memo was likely classified.

Former FBI general counsel James Baker is currently under criminal referral for improperly leaking classified documents. He seems to have been in contact with the media before the election and he may have been one of many FBI officials and contacts, along with Christopher Steele, that reporters such as David Corn, Michael Isikoff, and Julia Ioffe anonymously referenced in their pre-election published hit pieces on Russian collusion—all the result of the successful strategies of Fusion GPS, along with some in the FBI, to seed unverified anti-Trump gossip to warp the election. Andrew McCabe also is under criminal referral both for leaking classified information and then lying about it.

In a fashion emblematic of this entire sordid mess, the always ethically compromised James Clapper in January 2017 had leaked the dossier to Jake Tapper of CNN and likely other journalists and then shortly afterwards publicly deplored just this sort of government leaking that had led to sensational stories about the dossier.

Take Obstruction of Justice
A number of FBI and Department of Justice high ranking employees such as James Comey, Andrew McCabe, Rod Rosenstein, and Sally Yates all signed off on FISA warrants to surveille Carter Page without apprising the courts that they knew that their chief evidence, the Steele Dossier, was unverified, was paid for by Hillary Clinton, and was used in circular fashion as the basis for news accounts presented to the court. Nor did the Justice Department and FBI officials apprise the FISA justices that Christopher Steele had been terminated as a FBI source.

No one believes that former Attorney General Loretta Lynch just happened to meet Bill Clinton on a Phoenix airport tarmac and confined their conservations to a variety of topics having nothing to do with Hillary Clinton—at a time when Lynch’s Justice Department was investigating her. Note the meeting was only disclosed because a reporter got a tip and arrived on the scene of the two adjoining Lynch and Clinton private jets—which suggests that the only thing Lynch and Clinton regretted was being found out. Few believe that Lynch had recused herself as she promised, given her strict oversight of the sort of languageComey’s FBI was allowed to use in its investigation of Clinton.

Take Conflict of Interest
Andrew McCabe never should have been in charge of the FBI investigation of Hillary Clinton, given that just months earlier his wife had been the recipient of $675,000 in campaign cash donated by Clinton and Democratic Party-affiliated political action committees. And the apology of a “time line” that suggests conflicts of interest like McCabe’s expired after an arbitrary date is specious. McCabe knew his spouse had been a recent recipient of Clinton-related money, knew that he had substantial influence on the fate of her email investigation, and hoped and assumed that she was likely to be the next president of the United States quite soon.

Rod Rosenstein never should have been appointed acting attorney general in charge of oversight of the Mueller investigation. He knew Mueller well. In circular fashion, he had drafted the rationale to fire Comey that had prompted the Mueller’s appointment. He had signed off on a FISA warrant request without apprising the court of the true nature of the Steele dossier’s origins and nature. He had met shortly before the Mueller appointment with acting FBI director Andrew McCabe to investigate the chance of removing Trump under a distortion of the 25th Amendment. So, in essence, Rosenstein had been one of the catalysts for McCabe to investigate removing Trump for his own part in the removal of Comey and then in Orwellian fashion joined McCabe’s efforts.

Comey deliberately leaked a classified memo of a presidential conversation, in which he had misled the president about his actual status under FBI investigations, in order to cause enough media outrage over his firing to prompt the hiring of a special counsel. That gambit succeeded in the appointment of his own longtime associate Robert Mueller, who would be charged to investigate “collusion,” in which Comey played an important role in monitoring the Trump campaign with the assistance of British national Christopher Steele.

Robert Mueller did not need to appoint a legal team inordinately Democratic, which included attorneys who had been either donors to the Clinton campaign, or had been attorneys for Clinton aides, or had defended the Clinton Foundation. And he certainly should not have included on his investigative team that was charged with adjudicating Russian collusion in the 2016 election both Zainab Ahmad and Andrew Weissman, Obama Justice Department officials, who had been briefed by Bruce Ohr before the election on the nature of the Steele dossier and its use of foreign sources.

It will be difficult to unravel all of the above lying, distortion, and unethical and illegal conduct.

The motives of these bad actors are diverse, but they share a common denominator. As Washington politicos and administrative state careerists, all of them believed that Donald Trump was so abhorrent that he should be prevented from winning the 2016 election. After his stunning and shocking victory, they assumed further that either he should not be inaugurated or he should be removed from office as soon as they could arrange it.

They further reasoned that as high and esteemed unelected officials their efforts were above and beyond the law, and rightly so, given their assumed superior wisdom and morality.

Finally, if their initial efforts were predicated on winning not just exemption from the law, but even promotions and kudos from a grateful President Hillary Clinton, their subsequent energies at removing Trump and investing in the collusion hoax were preemptive and defensive. Seeding the collusion hoax was a way either of removing Trump who had the presidential power to call them all to account for their illegality, or at least causing so much media chaos and political havoc that their own crimes and misdemeanors would be forgotten by becoming submerged amid years of scandal, conspiracies, and media sensationalism.

And they were almost—but so far not quite—correct in all their assumptions.

Muellergate and the Discreet Lies of the Bourgeoisie

This cartoon seems to me very apposite. The capacity of the mainstream media repeatedly to promote the myth that Russia caused Clinton’s defeat, while never mentioning what the information was that had been so damaging to Hillary, should be alarming to anybody under the illusion that we have a working “free media”. There are literally hundreds of thousands of mainstream media articles and broadcasts, from every single one of the very biggest names in the Western media, which were predicated on the complete nonsense that Russia had conspired to install Donald Trump as President of the United States.

I genuinely have never quite understood whether the journalists who wrote this guff believed it, whether they were cynically pumping out propaganda and taking their pay cheque, or whether they just did their “job” and chose to avoid asking themselves whether they were producing truth or lies.

I suspect the answer varies from journalist to journalist. At the Guardian, for example, I get the impression that Carole Cadwalladr is sufficiently divorced from reality to believe all that she writes. Having done a very good job in investigating the nasty right wing British Establishment tool that was Cambridge Analytica, Cadwalladr became deluded by her own fame and self-importance and decided that her discovery was the key to understanding all of world politics. In her head it explained all the disappointments of Clintonites and Blairites everywhere. She is not so high-minded however as to have refused the blandishments of the Integrity Initiative.

Luke Harding is in a different category. Harding has become so malleable a tool of the security services it is impossible to believe he is not willingly being used. It would be embarrassing to have written a bestseller called “Collusion”, the entire premiss for which has now been disproven, had Harding not made so much money out of it.

Harding’s interview with Aaron Mate of The Real News was a truly enlightening moment. The august elite of the mainstream media virtually never meet anybody who subjects their narrative to critical intellectual scrutiny. Harding’s utter inability to deal with unanticipated scepticism descends from hilarious to toe-curlingly embarrassing.

In general, since the Mueller report confirmed that $50 million worth of investigation had been unable to uncover any evidence of Russiagate collusion, the media has been astonishingly unrepentant about the absolute rubbish they have been churning out for years.

Harding and the Guardian’s story about Manafort repeatedly calling on Assange in the Ecuador Embassy is one of the most blatant and malicious fabrications in modern media history. It has been widely ridiculed, no evidence of any kind has ever been produced to substantiate it, and the story has been repeatedly edited on the Guardian website to introduce further qualifications and acknowledgements of dubious attribution, not present as originally published. But still neither Editor Katherine Viner nor author Luke Harding has either retracted or apologised, something which calls the fundamental honesty of both into question.

Manafort is now in prison, because as with many others interviewed, the Mueller investigation found he had been involved in several incidences of wrongdoing. Right up until Mueller finalised his report, media articles and broadcasts repeatedly, again and again and again every single day, presented these convictions as proving that there had been collusion with Russia. The media very seldom pointed out that none of the convictions related to collusion. In fact for the most part they related to totally extraneous events, like unrelated tax frauds or Trump’s hush-money to (very All-American) prostitutes. The “Russians” that Manafort was convicted of lobbying for without declaration, were Ukrainian and the offences occurred ten years ago and had no connection to Trump of any kind. Rather similarly the lies of which Roger Stone stands accused relate to his invention, for personal gain, of a non-existent relationship with Wikileaks.

The truth is that, if proper and detailed investigation were done into any group of wealthy politicos in Washington, numerous crimes would be uncovered, especially in the fields of tax and lobbying. Rich political operatives are very sleazy. This is hardly news, and if those around Clinton had been investigated there would be just as many convictions and of similar kinds. it is a pity there is not more of this type of work, all the time. But the Russophobic motive behind the Mueller Inquiry was not forwarded by any of the evidence obtained.

My analysis of the Steele dossier, written before I was aware that Sergei Skripal probably had a hand in it, has stood the test of time very well. It is a confection of fantasy concocted for money by a charlatan.

We should not forget at this stage to mention the unfortunate political prisoner Maria Butina, whose offence is to be Russian and very marginally involved in American politics at the moment when there was a massive witchhunt for Russian spies in progress, that makes The Crucible look like a study in calm rationality. Ms Butina was attempting to make her way in the US political world, no doubt, and she had at least one patron in Moscow who was assisting her with a view to increasing their own political influence. But nothing Butina did was covert or sinister. Her efforts to win favour within the NRA were notable chiefly because of the irony that the NRA has been historically responsible for many more American deaths than Russia.

Any narrative of which the Establishment does not approve is decried as conspiracy theory. Yet the “Russiagate” conspiracy theory – which truly is Fake News – has been promoted massively by the entire weight of western corporate and state media. “Russiagate”, a breathtaking plot in which Russia and a high profile US TV personality collude together to take control of the most militarily powerful country in the world, knocks “The Manchurian Candidate” into a cocked hat. A Google “news search” restricts results to mainstream media outlets. Such a search for the term “Russiagate” brings 230,000 results. That is almost a quarter of a million incidents of the mainstream media not only reporting the fake “Russiagate” story, but specifically using that term to describe it.

Compare that with a story which is not an outlandish fake conspiracy theory, but a very real conspiracy.

If, by contrast, you do a Google “news search” for the term “Integrity Initiative”, the UK government’s covert multi million pound programme to pay senior mainstream media journalists to pump out anti-Russian propaganda worldwide, you only get one eighth of the results you get for “Russiagate”. Because the mainstream media have been enthusiastically promoting the fake conspiracy story, and deliberately suppressing the very real conspiracy in which many of their own luminaries are personally implicated.

Furthermore – and this is a truly tremendous irony, which relates back to the cartoon at the start – only two of the top ten news results for “Integrity Initiative” comes from the Western corporate media.

And this next fact comes nearly into the “too good to be true” category for my argument. Those two MSM mentions, from Sky News and the Guardian, do not complain of the covert anti-Russian propaganda campaign that is the Integrity Initiative. They rather complain that it was an alleged “Russian hack” that made the wrongdoing public!! You could not make it up, you really could not.

According to the mainstream media, it is not Hillary Clinton’s fault for conspiring with the DNC to cheat Bernie out of the nomination, it is Russia’s fault for allegedly helping to reveal it. It is not the British government’s, or their media collaborators’, fault for running a covert propaganda scheme to dupe the public of the UK and many other countries, it is the Russians’ fault for allegedly helping to reveal it!

Which brings us full circle to the DNC leak that sparked Muellergate and the claims that it was the Russians who lost Hillary the election. Robert Mueller repeats the assertion from the US security services that it was Russian hackers who obtained the DNC emails and passed them on to Wikileaks. I am telling you from my personal knowledge that this is not true.

Neither Mueller’s team, not the FBI, nor the NSA, nor any US Intelligence agency, has ever carried out any forensic analysis on the DNC’s servers. The DNC consistently refused to make them available. The allegation against Russia is based purely on information from the DNC’s own consultants, Crowdstrike.

William Binney, former Technical Director of the NSA (America’s US$40 billion a year communications intercept organisation), has proven beyond argument that it is a technical impossibility for the DNC emails to have been transmitted by an external hack – they were rather downloaded locally, probably on to a memory stick. Binney’s analysis is fully endorsed by former NSA systems expert Ed Loomis. There simply are no two people on the planet more technically qualified to make this judgement. Yet, astonishingly, Mueller refused to call Binney or Loomis (or me) to testify. Compare this, for example, with his calling to testify my friend Randy Credico, who had no involvement whatsoever in the matter, but Mueller’s team hoped to finger as a Trump/Assange link.

The DNC servers have never been examined by intelligence agencies, law enforcement or by Mueller’s team. Binney and Loomis have written that it is impossible this was an external hack. Wikileaks have consistently stressed no state actor was involved. No evidence whatsoever has been produced of the transfer of the material from the “Russians” to Wikileaks. Wikileaks Vault 7 release of CIA documents shows that the planting of false Russian hacking “fingerprints” is an established CIA practice. Yet none of this is reflected at all by Mueller nor by the mainstream media.

“Collusion” may be dead, but the “Russiagate” false narrative limps on.

I should add it seems to me very probable Russia did make some efforts to influence the US election. I worked a a British diplomat for 20 years and spent a lot of time trying to influence political outcomes in the country in which I was posted, in Eastern Europe and in Africa. It is part of the geopolitical game. The United States is of course the world leader by a long way in attempting to influence elections abroad, spending hundreds of millions of dollars to that effect in countries including Ukraine, Georgia, Ecuador and Venezuela recently, and pretty well everywhere in Africa. It is a part of normal diplomatic life.

Mueller uncovered some high level influence-broking meetings. This is what states do. He uncovered some sleazy deals. This is what rich people do. He uncovered some US $110,000 of Facebook ad spending from Russia targeted on the USA, some of which promoted sex toys, some of which was post-election, but some of which was apparently trying to assist Trump against Russia. Compared to the amount the USA pumps into similar arms length assistance to Putin opponents in Russia alone, it was negligible. That this tiny bit of Facebook advertising crucially impacted the US $13,000,000,000 PR campaigns of the candidates is a ludicrous proposition.

That every country stay out of every other country’s politics is arguably desirable. It is not however the status quo, and the United States is in the worst position of all to complain.

Did FBI Violate Woods Procedures with Trump-Russia Probe?

With Special Counsel Robert Mueller’s probe over, we have been told there will be no Trump-Russia related indictments. One of the many unknowns, since the report has yet to be released, is how far Mueller’s investigation took him in the direction of a key question: How did the false Trump-Russia narrative become so embedded not only in our media landscape, but also within the FBI? Did some intel officials violate policies or even laws?

The following story was first published in The Hill in February 2018.

For all the debate over the House Republican memo pointing to alleged misconduct by some current and former FBI and Justice Department officials, one crucial point hasn’t gotten the attention it deserves.  And it relates in an unexpected way to special counsel Robert Mueller. The point is: There are strict rules requiring that each and every fact presented in an FBI request to electronically spy on a U.S. citizen be extreme-vetted for accuracy — and presented to the court only if verified. 

There’s no dispute that at least some, if not a great deal, of information in the anti-Trump “Steele dossier” was unverified or false. Former FBI director James Comey testified as much himself before a Senate committee in June 2017. Comey repeatedly referred to “salacious” and “unverified” material in the dossier, which turned out to be paid political opposition research against Donald Trump funded first by Republicans, then by the Democratic National Committee and the Hillary Clinton campaign. 

Presentation of any such unverified material to the Federal Intelligence Surveillance Act (FISA) court to justify a wiretap would appear to violate crucial procedural rules, called “Woods Procedures,” designed to protect U.S. citizens. 

Yet Comey allegedly signed three of the FISA applications on behalf of the FBI. Deputy Director Andrew McCabe reportedly signed one and former Attorney General Sally Yates, then-Acting Deputy Attorney General Dana Boente and Deputy Attorney General Rod Rosenstein each reportedly signed one or more.

 Woods Procedures  

Woods Procedures were named for Michael Woods, the FBI official who drafted the rules as head of the Office of General Counsel’s National Security Law Unit. They were instituted in April 2001 to “ensure accuracy with regard to … the facts supporting probable cause” after recurring instances, presumably inadvertent, in which the FBI had presented inaccurate information to the FISA court.  

Prior to Woods Procedures, “[i]ncorrect information was repeated in subsequent and related FISA packages,” the FBI told Congress in August 2003. “By signing and swearing to the declaration, the headquarters agent is attesting to knowledge of what is contained in the declaration.” 

It’s incredible to think of how many FBI and Justice Department officials would have touched the multiple applications to wiretap Trump campaign adviser Carter Page — allegedly granted, at least in part, on the basis of unverified and thus prohibited information — if normal procedures were followed. The FBI’s complex, multi-layered review is designed for the very purpose of preventing unverified information from ever reaching the court. It starts with the FBI field offices.  

According to former FBI agent Asha Rangappa, who wrote of the process last year in JustSecurity.org, the completed FISA application requires approval through the FBI chain of command “including a Supervisor, the Chief Division Counsel (the highest lawyer within that FBI field office), and finally, the Special Agent in Charge of the field office, before making its way to FBI Headquarters to get approval by (at least) the Unit-level Supervisor there.” At FBI headquarters, an “action memorandum” is prepared with additional facts culled by analytical personnel assigned to espionage allegations involving certain foreign powers.  Next, it goes to the Justice Department “where attorneys from the National Security Division comb through the application to verify all the assertions made in it,” wrote Rangappa. “DOJ verifies the accuracy of every fact stated in the application. If anything looks unsubstantiated, the application is sent back to the FBI to provide additional evidentiary support – this game of bureaucratic chutes and ladders continues until DOJ is satisfied that the facts in the FISA application can both be corroborated and meet the legal standards for the court. After getting sign-off from a senior DOJ official (finally!).”

 There’s more 

But there are even more reviews and processes regarding government applications for wiretaps designed to make sure inaccurate or unverified information isn’t used.  

In November 2002, the FBI implemented a special FISA Unit with a unit chief and six staffers, and installed an automated tracking system that connects field offices, headquarters, the National Security Law Branch and the Office of Intelligence, allowing participants to track the process during each stage. 

Starting March 1, 2003, the FBI required field offices to confirm they’ve verified the accuracy of facts presented to the court through the case agent, the field office’s Chief Division Counsel and the Special Agent in Charge. All of this information was provided to Congress in 2003. The FBI director at the time also ordered that any issue as to whether a FISA application was factually sufficient was to be brought to his attention. Personally. 

Who was the director of the FBI when all of this careful work was done? 

Robert Mueller. 

Perhaps ironically, Mueller isn’t in charge of the investigation examining the conduct of FBI and Justice Department officials and whether they followed the rules he’d carefully implemented 15 years before. Instead, Mueller is leading the probe into Russia’s alleged illegal connections with Trump associates.

Congress is looking at the wiretap process. With so much information still classified, redacted and — in some cases — withheld, there is much we don’t know. Perhaps we will eventually learn that there’s a good reason unverified material was given to the court. Maybe there was no violation of rules or processes. 

But there’s a reason Woods Procedures exist in the first place. They aren’t arcane rules that could have been overlooked or misunderstood by the high-ranking and seasoned professionals working under the Obama and Trump administrations who touched the four Carter Page wiretap applications and renewals. And unless they’ve secretly been lifted or amended, Woods Procedures aren’t discretionary. 

In the past, when the FBI has presented inaccuracies to the FISA court, it’s been viewed so seriously that it’s drawn the attention of the Department of Justice Office of Professional Responsibility, which investigates Justice Department attorneys accused of misconduct or crimes in their professional functions.
